Madison County Sheriff Ben Stewart reports that on Thursday night the 17th day of January 2013 at 11:09 pm, Sgt. Dennis Pitts and Captain David Harper were patrolling the area of Bentley Street when they observed a male subject dressed in all black clothing riding a three wheel bicycle with a large basket on the back. The officers immediately recognized the current temperature being 44 degrees and the male subject was wearing a thin short sleeve black shirt and was using his black jacket to conceal some type of large metal items in the basket.Sgt. Pitts and Captain Harper activated emergency lights to stop the subject. The subject turned into a yard and rode the bike around the back of the residence then got off and started to walk away. Sgt. Pitts ordered the subject to stop and he complied stating that he lived there. At that point the metal objects were more visible and recognized to be air conditioner coils and appeared to have been cut out of an A/C unit.
The subject was identified as Davion McDaniel of Madison Florida. Sgt. Pitts conducted a pat down of McDaniel and located a large tire tool concealed in McDaniel’s right pant leg and a screwdriver, set of pliers and pair of latex gloves in his pocket. McDaniel stated that he removed the A/C parts and other copper from a burned down house on happy street that was owned by his dad and he had permission to take the items. The burned residence was located and determined to be owned by someone other than McDaniel’s father. Due to the time of night, tools in McDaniel’s possession and the attempt to conceal the three A/C coils and copper, McDaniel was placed under arrest. It was also determined that McDaniel did not live at the residence like he initially claimed and refused to tell deputies where his residence was located.
McDaniel was arrested and charged as follows:
